TERMS AND CONDITIONS

General Notes
The company EAT VOILA VAT No. 01659730087 sells products under the EAT VOILA brand ("products"). The remote sales process described in these general terms and conditions is reserved exclusively for final consumers (hereinafter "customers"), who act solely on their own behalf and are residents of the European Union or outside the EU.

GENERAL TERMS OF SALE

These sales conditions apply to all products purchased through the website ruedesmille.it with deliveries throughout the European Union and non-EU countries. Customers must be aware of these conditions before completing their online product purchase. The customer therefore agrees to comply with these terms in dealings with Eat Voila and acknowledges that Eat Voila is not bound by different conditions unless previously agreed in writing. These general sales conditions remain valid as long as they are accessible on the website.

PURCHASE METHODS

Products available on the e-shop can be purchased while stocks last. Orders are placed directly after completing the order process and check-out. EAT VOILA reserves the right to evaluate the acceptance of received orders and will inform the customer directly if the order cannot be accepted. Pursuant to Article 53 of the Consumer Code, the customer will receive written confirmation of the ordered product, the amount paid, including product price and shipping costs.
Once the order is finalized, the user will receive an email with login credentials for future orders. From the moment the order confirmation email is sent, delivery times will depend on the type of product purchased. Depending on the destination area, orders will be processed and delivered from Monday to Friday, excluding public holidays, within 5 to 7 working days from order confirmation and payment. Orders may be delayed during national holidays according to the local calendar.
The customer can choose among the following payment methods, regardless of the purchase channel:
a) Cash on delivery: payment in cash or, in most areas with mobile coverage, by debit card or contactless credit card. Cash payment is allowed only for amounts not exceeding the legal limit and must be made directly to the courier upon delivery.
b) Electronic payments: via the methods indicated at the time of order, including accepted credit cards, PayPal, Amazon Pay, Apple Pay (only on Apple devices), Klarna. Eat Voila uses the Adyen banking gateway to manage electronic payments. Credit cards issued by any bank are accepted, provided they belong to authorized networks. With these methods, the charge occurs at the time of the order. In case of anomalies during authorization or payment, Eat Voila reserves the right to reject the order and/or terminate the contract, with no entitlement to compensation or other claims. Eat Voila also reserves the right to add new electronic payment methods, which will be announced on the website.
c) Advance bank transfer: any transfer fees or bank charges are the sole responsibility of the customer.
PURCHASES BY MINORS
Minors under the age of 18 are not authorized to place orders via the online form unless supervised by an adult family member. Eat Voila assumes no responsibility for any false statements about age provided at the time of purchase.

PRODUCT PRICES

All displayed prices include VAT, containers, and packaging. For shipments to countries outside the European Union, customs duties will be borne by the recipient and added to shipping costs. Product prices may vary, increasing or decreasing; therefore, the customer is advised to check their accuracy before placing an order. In case of pricing errors due to system malfunctions or technical issues, Eat Voila will promptly contact the customer to inform them of the correct price and to confirm whether they wish to proceed with the purchase or cancel the order.

LEGAL WARRANTY OF CONFORMITY

All purchased products benefit from the legal warranty of conformity. Pursuant to Articles 128-135 septies of the Consumer Code, Eat Voila by Davide Paolino applies the legal warranty to the consumer customer. Eat Voila is responsible for any lack of conformity that exists at the time of delivery and manifests within two years from that date, unless a shorter period is indicated (such as an expiration or best-before date). The customer must report the defect within two months of discovering it. Unless proven otherwise, it is presumed that any conformity defect appearing within one year of delivery existed at the time of delivery, unless this is incompatible with the nature of the product (e.g. perishable goods) or the nature of the defect (e.g. wear due to use). Damage or defects caused by the customer that are not related to conformity issues are excluded from the warranty. The action to enforce the warranty is in any case time-barred after one year from delivery. In case of a defect, the customer has the right to have the product restored free of charge by replacement, or to a proportional price reduction or contract termination, as provided by the Consumer Code. The customer must report any defect or non-conformity to the contact details listed in paragraph 13 or on the website, specifying the issue and attaching proof of purchase. Eat Voila will then contact the customer to manage the warranty process in a timely manner, considering the product type, defect nature, and availability of replacement. If replacement is necessary, Eat Voila will inform the customer about pickup times and methods, at no cost to the customer.
